Objectives:
This course is intended as an introduction to the U.S. wage and hour laws. Through this course you will:
• Learn the purpose and a brief history of the U.S. Department of Labor and understand various acts initiated by the Department.
• Be provided with terms commonly used by the Department of Labor, and learn the definitions and calculations of wage and hour requisites used in the Fair Labor Standards Act.
• Learn specifics about the Fair Labor Standards Act including its limitations and scope of coverage.
• Realize the specifics regarding basic payroll laws.
• Understand the Wage and Hour Division enforcement procedures for both unfair labor practices and collection of back pay.
About the Author:
Colleen Neuharth McClain is a certified public accountant (CPA) practicing in the fields of financial accounting and controllership as a sole proprietor. She is a graduate of the University of Texas and has served for more than 15 years as a controller for various organizations; small and large, public and private, domestic and international. She is now sharing her knowledge and experiences with other accountants through writing continuing education material and exam questions.
Colleen has written and reviewed hundreds of exam questions for the American Institute of Certified Public Accountants (AICPA) over the past 5 years which are intended to appear in the database of potential CPA exam items.
She is also currently writing for the AICPA and various other continuing education sponsors in the hopes of helping to educate her fellow CPA’s in the field of financial accounting. Colleen has written approximately 20 courses over the past three years on everything from how to open a home office to the appropriate way to account for equity based compensation.
Colleen has also just had published her 12 hour seminar regarding the recent changes to the Department of Labor - Wage and Hour Divisions’ Fair Labor Standards Act.
Course Description:
This course provides an overview of the wage and hour laws as mandated by the U.S. Department of Labor under the Fair Labor Standards Act. Wage and hour laws have been in place for some time now; however, changes to existing laws and new laws do come about. A recent change to the Fair Labor Standards Act went into effect August 23, 2004 and is defined by the Department as the “FairPay rules.” This new law guarantees overtime protection to salaried employees earning less than $23,660 per year - or $455 per week - thereby strengthening overtime rights for millions of American workers who were previously denied overtime under the old rules.
The Department of Labor enforces more than 180 federal labor laws. These mandates and the regulations that implement them cover many workplace activities for about 10 million employers and 125 million workers. Minimum wage, overtime pay, freedom from employment discrimination, unemployment insurance, and workers’ compensation are areas of high concern.
